About Random Drug Testing

Random drug test is a kind of drug test that do not affect all the people in testing group but only those who has been selected by some random selection method. Selection methods are ranging from drawing names out of a hat to different random number generators.

Random drug test is one of the most effective drug testing formats, because its random nature makes test hard to cheat.

Every year random drug testing is used by a growing number of drug rehab centers, corporations, police and fire departments, the military, prisons, and government agencies. Random drug testing may also be used on teens by their parents, or at school. The Office of US National Drug Control Policy affirms that random drug testing in schools is reducing drug use among teens who are already using and deters drug use among others. The deterrence is the main aim of a random drug test, because the threat of detection is much higher in comparison with other drug testing methods.

Why Random?

The first reason of using random drug test is, as has been noticed earlier, that this kind of test is hard to cheat. The test is performing randomly, so nobody knows when he or she will be testing and can not prepare to pass a drug test. So, the probability of drug detection among users during random test are higher than in scheduled tests.

Another reason is the cost of testing. The cheapest immunoassay urine test costs about $4 per test. Applied to all without exception it can lead to thouthands of dollars outlays in big companies, schools or police departments. But, the easy, cheap and quick immunoassay tests can only be used as a preliminary testing tool. Some tests can have false-positive result, because unwanted substances can be found in commonly taken medications, even herbal teas can produce false-positive results. So, any result, marked as positive, requires another more sensitive confirmatory test to make sure it's really positive. And confirmatory tests have to be also added to the cost. Even if using the cheapest tests the whole testing can be costly for many companies, especially as frequent drug testing increases a deterrent effect of procedure. For example, in one of the US school districts, where only 11 students has been tested positive, the cost of testing amounted to $35 000.

Random drug test helps to cut down testing expenses by affecting less people, but saves its deterrent effect for everybody and reduces the cheating possibilities.

Critics

The opponents of random drug testing assert that it introduces a presumption of guilt, and violates the privacy, except when drug user is actually intoxicated during working time.

Random drug testing at workplace became legal in 1986 when Ronald Reagan signed executive order about drug-free federal workplace. It was the first drug testing law. Although it applies to the federal workplaces only, private employers immediately started random workplace drug testing. But still now there is much controversy over the legality of random drug testing and other kinds of drug testing at the workplace. Many lawyers assert that this is a personal privacy invasion and random drug testing is illegal, because an unreasonable search and seizure is prohibited by the Fourth and Fourteenth Amendments to the United States Constitution.

The Fourth Amendment guarantees " the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures "

Many federal and state courts have decided that random drug testing at workplaces is unconstitutional if it is not based on an individualized suspicion. In many states courts have stopped random drug testing programs that had randomly tested teachers, fire-fighters, police officers, prison guards and employees of many federal agencies. One federal judge in Washington, D.C. said about a random drug testing program: "This case presents for judicial consideration a wholesale deprivation of the most fundamental privacy rights of thousands upon thousands of loyal, law-abiding citizens".
