About Random Drug Testing

Why Random?


The first reason of using random drug test is, as has been noticed earlier, that this kind of test is hard to cheat. The test is performing randomly, so nobody knows when he or she will be testing and can not prepare to pass a drug test. So, the probability of drug detection among users during random test are higher than in scheduled tests.

Another reason is the cost of testing. The cheapest immunoassay urine test costs about $4 per test. For example, in one of the US school districts, where only 11 students has been tested positive, the cost of testing amounted to $35 000.

Random drug test helps to cut down testing expenses by affecting less people, but saves its deterrent effect for everybody and reduces the cheating possibilities.


Critics


The opponents of random drug testing assert that it introduces a presumption of guilt, and violates the privacy, except when drug user is actually intoxicated during working time.

Random drug testing at workplace became legal in 1986 when Ronald Reagan signed executive order about drug-free federal workplace. It was the first drug testing law. Although it applies to the federal workplaces only, private employers immediately started random workplace drug testing. But still now there is much controversy over the legality of random drug testing and other kinds of drug testing at the workplace. Many lawyers assert that this is a personal privacy invasion and random drug testing is illegal, because an unreasonable search and seizure is prohibited by the Fourth and Fourteenth Amendments to the United States Constitution.

The Fourth Amendment guarantees " the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures "

Many federal and state courts have decided that random drug testing at workplaces is unconstitutional if it is not based on an individualized suspicion. In many states courts have stopped random drug testing programs that had randomly tested teachers, fire-fighters, police officers, prison guards and employees of many federal agencies. One federal judge in Washington, D.C. said about a random drug testing program: "This case presents for judicial consideration a wholesale deprivation of the most fundamental privacy rights of thousands upon thousands of loyal, law-abiding citizens".
